These Terms constitute a legally binding contract between you and Trueecaler under the applicable laws of India, including but not limited to the Information Technology Act, 2000 ("IT Act"), the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Consumer Protection Act, 2019, and any other relevant Indian legislation. This Agreement is enforceable under Section 10A of the IT Act, which recognises the validity of contracts formed electronically.
You represent and warrant that:
- You are at least 18 years of age or have attained the age of majority in your jurisdiction;
- You have the legal capacity and authority to enter into this Agreement;
- You are not barred from receiving services under the laws of India or any other applicable jurisdiction;
- All information you provide to us is accurate, current, and complete.
If you are accessing these services on behalf of a business entity, you represent that you are authorised to bind such entity to these Terms, and references to "you" shall apply to both the individual and such entity.
2. Description of Services

4. Prohibited Activities
In using our services, you agree to comply with all applicable Indian laws and regulations, including but not limited to the IT Act, 2000, the Indian Penal Code, 1860 (as amended by the Bharatiya Nyaya Sanhita, 2023), and the Telecom Regulatory Authority of India (TRAI) guidelines. You expressly agree that you will not engage in any of the following prohibited activities:
4.1 Illegal and Harmful Conduct
- Using our services for any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
- Engaging in fraudulent activities, identity theft, phishing, or misrepresentation of any kind;
- Uploading, transmitting, or distributing any content that is defamatory, obscene, pornographic, hateful, threatening, or otherwise objectionable under Indian law;
- Engaging in any activity that violates the privacy rights of third parties under the IT Act, 2000 and the Digital Personal Data Protection Act, 2023.
4.2 Technical Misuse
- Attempting to gain unauthorised access to our systems, servers, networks, or databases;
- Introducing malware, viruses, Trojan horses, worms, or any other malicious code into our platform;
- Using automated bots, scrapers, crawlers, or similar tools to access, collect, or copy data from our services without prior written authorisation;
- Reverse engineering, decompiling, or disassembling any portion of our software or technology;
- Circumventing or attempting to circumvent any security measures, access controls, or content filtering mechanisms employed by Trueecaler;
- Conducting denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against our infrastructure.
4.3 Misuse of Platform Features
- Submitting false, misleading, or inaccurate information to our caller identification or spam reporting databases;
- Deliberately misrepresenting the identity of a caller or business entity;
- Using our platform to harass, stalk, or threaten any individual or entity;
- Creating multiple accounts for fraudulent purposes or to circumvent account suspensions;
- Reselling, sublicensing, or commercialising our services without express written authorisation from Trueecaler;
- Using our API services in a manner that violates our API usage policies or exceeds authorised rate limits.
Trueecaler reserves the right to investigate any suspected violation of these prohibitions and to take appropriate action, including account suspension, termination, and reporting to law enforcement authorities as required under Section 79 of the IT Act, 2000 and applicable TRAI regulations.
5. Intellectual Property Rights
All content, features, functionality, software, designs, graphics, logos, trademarks, trade names, service marks, text, images, audio, video, data compilations, and other materials available on trueecaler.com ("Intellectual Property") are owned by Trueecaler or its licensors and are protected under applicable Indian and international intellectual property laws, including:
- The Copyright Act, 1957;
- The Trade Marks Act, 1999;
- The Patents Act, 1970;
- The Information Technology Act, 2000;
- Applicable international conventions and treaties to which India is a signatory.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use our services solely for your personal, non-commercial use, subject to these Terms. This licence does not include any right to:
- Reproduce, modify, distribute, display, or create derivative works from our Intellectual Property;
- Use any data mining, robots, or similar data gathering or extraction tools;
- Remove or alter any copyright, trademark, or proprietary notices on our content;
- Use our trademarks or brand assets without prior written consent from Trueecaler.
Any feedback, suggestions, ideas, or other submissions you provide to us may be used by Trueecaler without any obligation to compensate you, and by submitting such content, you waive any moral rights or claims you may have in relation to such submissions to the extent permissible under Indian law.
User-generated content uploaded to our platform remains the property of the respective user; however, by submitting such content, you grant Trueecaler a worldwide, royalty-free, perpetual, irrevocable licence to use, store, reproduce, adapt, and display such content for the purposes of operating and improving our services.
6. Payment Terms and Subscriptions
Certain features and services offered by Trueecaler are available on a paid subscription basis ("Premium Services"). The following terms apply to all purchases and subscriptions made through our platform:
6.1 Pricing and Billing
- All prices are displayed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) as required under the Central Goods and Services Tax Act, 2017, unless otherwise stated;
- Subscription fees are billed in advance on a monthly or annual basis, as selected at the time of purchase;
- We reserve the right to modify our pricing at any time with reasonable prior notice to existing subscribers.
6.2 Payment Processing
- Payments are processed through secure, third-party payment gateways compliant with applicable Reserve Bank of India (RBI) guidelines and the Payment and Settlement Systems Act, 2007;
- By providing payment information, you authorise Trueecaler to charge the applicable fees to your designated payment method;
- All transactions are encrypted and processed in accordance with Payment Card Industry Data Security Standards (PCI-DSS).
6.3 Refund Policy
- Refund requests for Premium Services must be submitted within seven (7) days of the initial purchase date;
- Refunds will not be issued for partial subscription periods or after the seven-day window has elapsed;
- In cases of technical failures attributable to Trueecaler that have materially impacted service delivery, refunds may be considered on a case-by-case basis;
- Refunds, where applicable, will be processed within fifteen (15) business days and credited to the original payment method.
6.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date. You may cancel your subscription at any time through your account settings. Cancellations made after a billing cycle has commenced will not result in a refund for that period.
7. Disclaimers and "As-Is" Basis
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, THE SERVICES PROVIDED BY TRUEECALER ARE OFFERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRUEECALER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
- WARRANTIES AS TO THE ACCURACY, RELIABILITY, COMPLETENESS, OR CURRENCY OF ANY INFORMATION PROVIDED THROUGH OUR SERVICES, INCLUDING CALLER IDENTIFICATION DATA;
- WARRANTIES THAT ANY DEFECTS IN THE PLATFORM WILL BE CORRECTED.
Trueecaler does not warrant or guarantee the accuracy of caller identification information, spam classifications, or contact data displayed on our platform. Such information is aggregated from community inputs, third-party data sources, and algorithmic processing, and may not reflect current or accurate details. Users are advised to exercise independent judgment when relying on such information.
Nothing in these Terms shall exclude any statutory rights you may have as a consumer under the Consumer Protection Act, 2019 or other applicable Indian consumer protection legislation, to the extent such rights cannot be excluded by contract.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW IN INDIA, TRUEECALER, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
- ANY DIRECT DAMAGES EXCEEDING THE TOTAL AMOUNT PAID BY YOU TO TRUEECALER IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR RUPEES FIVE THOUSAND (INR 5,000), WHICHEVER IS LOWER;
- ANY LOSS OR DAMAGE ARISING FROM UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS;
- ANY CONDUCT OR CONTENT OF THIRD PARTIES ON OR THROUGH OUR SERVICES;
- ANY ERRORS OR INACCURACIES IN CALLER IDENTIFICATION OR SPAM DETECTION DATA;
- DECISIONS MADE BY USERS IN RELIANCE ON INFORMATION PROVIDED THROUGH OUR SERVICES.
This limitation of liability applies regardless of the legal theory upon which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, and shall apply even if Trueecaler has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages; in such cases, liability shall be limited to the maximum extent permitted by applicable law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Trueecaler and its officers, directors, employees, shareholders, affiliates, agents, licensors, and successors from and against any and all claims, liabilities, damages, losses, costs, expenses, and legal fees (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of or access to the services at trueecaler.com;
- Your breach of any provision of these Terms of Service;
- Your violation of any applicable law, regulation, rule, or guideline, including Indian laws;
- Your infringement of any intellectual property right, privacy right, or other right of any third party;
- Any content, data, or information submitted, uploaded, or transmitted by you through our services;
- Any wilful misconduct, negligence, or fraudulent activity on your part.
Trueecaler reserves the right, at your expense, to assume exclusive control over the defence and settlement of any matter subject to indemnification by you. You agree to cooperate fully with Trueecaler's defence of any such claims. You shall not settle any claim that imposes any obligation, restriction, or liability on Trueecaler without our prior written consent.
10. Third-Party Links and Services
Our platform may contain links to third-party websites, services, applications, or content that are not owned or controlled by Trueecaler. Such links are provided for informational purposes only. Trueecaler has no control over, and assumes no responsibility for, the content, privacy policies, practices, or terms of any third-party services. We strongly advise you to review the terms and privacy policies of any third-party services you visit or engage with.
The inclusion of any link on our platform does not imply endorsement, sponsorship, or recommendation of the linked site or its operators. Trueecaler shall not be liable for any damages or losses arising from your use of or reliance on third-party websites or services.
11. Privacy and Data Protection
Your privacy is critically important to us. Our collection, use, processing, and storage of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in our Privacy Policy.
We comply with applicable Indian data protection legislation, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the Digital Personal Data Protection Act, 2023 ("DPDP Act"). 12. Governing Law and Jurisdiction

Subject to the dispute resolution provisions below, you irrevocably submit to the exclusive jurisdiction of the competent courts located in India for the resolution of any disputes arising out of or relating to these Terms or your use of our services. If you are a consumer as defined under the Consumer Protection Act, 2019, you may also approach the appropriate consumer dispute redressal forum or commission in your jurisdiction.
13. Dispute Resolution
13.1 Informal Resolution

We will endeavour to acknowledge your complaint within 24 hours and resolve it within 15 days of receipt, in accordance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
13.2 Arbitration
If a dispute cannot be resolved through informal means within thirty (30) days of the initial complaint, either party may refer the matter to binding arbitration. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The following terms shall apply:
- The arbitration shall be presided over by a sole arbitrator mutually agreed upon by both parties;
- The language of arbitration shall be English;
- The seat of arbitration shall be India;
- The arbitrator's decision shall be final and binding on both parties;
- Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise.
13.3 Consumer Disputes
Nothing in this dispute resolution clause shall be construed as limiting your rights as a consumer to approach the Consumer Dispute Redressal Commission or Forum as provided under the Consumer Protection Act, 2019. Users may also utilise the Government of India's National Consumer Helpline (NCH) or the Online Dispute Resolution (ODR) platform at consumerhelpline.gov.in.
14. Term and Termination
14.1 Term
These Terms shall remain in full force and effect for as long as you use our services or maintain an account with Trueecaler, whichever is longer.
14.2 Termination by User
You may terminate your account and these Terms at any time by deactivating your account through the account settings on our platform or by contacting us at [email protected]. Upon termination, your right to access and use our services will immediately cease.
14.3 Termination by Trueecaler
Trueecaler reserves the right to suspend, restrict, or permanently terminate your access to our services, with or without prior notice, in the following circumstances:
- You have breached any provision of these Terms;
- We are required to do so by law, court order, or regulatory authority;
- Your conduct poses a risk to the safety, security, or integrity of our platform or other users;
- Extended periods of account inactivity;
- We have decided to discontinue the relevant service.
14.4 Effect of Termination
Upon termination, all rights and licences granted to you under these Terms shall immediately terminate. Provisions of these Terms that by their nature should survive termination shall continue in full force and effect, including but not limited to Sections 5 (Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), 12 (Governing Law), and 13 (Dispute Resolution).
15. Changes to These Terms
Trueecaler reserves the right to modify, update, or revise these Terms of Service at any time at our sole discretion. We will provide notice of material changes by:

16. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction or an arbitral tribunal to be invalid, unlawful, void, or unenforceable for any reason, such provision shall be deemed severed from these Terms to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the extent possible to reflect the parties' original intent and to make it enforceable under applicable law.
The failure of Trueecaler to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver shall only be effective if made in writing and signed by an authorised representative of Trueecaler.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies or supplemental terms incorporated herein by reference, constitute the entire agreement between you and Trueecaler with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, negotiations, representations, and understandings, whether written or oral, between the parties relating to such subject matter.
No modification to these Terms shall be effective unless made in writing and duly executed by an authorised representative of Trueecaler, except as provided in Section 15 above regarding unilateral amendments to the Terms.
18. Force Majeure
Trueecaler shall not be held liable for any delay or failure to perform its obligations under these Terms arising from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government restrictions, strikes, civil unrest, wars, cyberattacks on critical infrastructure, power outages, internet service disruptions, or any other event of force majeure as recognised under Indian law. In such circumstances, our obligations shall be suspended for the duration of the force majeure event, and we shall use commercially reasonable efforts to resume services as soon as practicable.
19. Assignment
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without the prior written consent of Trueecaler. Any attempted assignment in violation of this provision shall be null and void. Trueecaler may freely assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, or by operation of law, without your consent. These Terms shall be binding upon and inure to the benefit of the successors and permitted assigns of both parties.
